help false chromatic relationship

hi, I knew that in literature there are cases where the false relation is used and among these is phraseology, like arpeggios that break the chord etc. I would like to know if at measure 10 it could be a change of position that creates phrasing and therefore falls within this category or if it is incorrect.

If at the same octave but in different voices, it is still chromaticism and not a false relation
